General purchase terms and conditions
The purchasing system complies with current Spanish law.
By using the services offered by the TEMATIKA online store, users are consenting to be bound by the General Purchase Terms and Conditions corresponding to the version published by TEMATIKA when the purchase order is placed. It is therefore advisable for customers to read these General Terms and Conditions before making a purchase.
1. Scope of this Agreement
These General Purchase Terms and Conditions are applicable to the online sale of all TEMATIKA products to consumers and which may be delivered in Europe (Euro Zone only).
TEMATIKA hereby informs you that its website is for persons aged 18 and over only. TEMATIKA reserves the right to cancel a user’s access account if it detects fraudulent, speculative acts or acts in bad faith in the use of this service.
2. Limits on purchases
Attending security reasons, no purchases worth more tan 1,500 € or containing more than 40 items per order will be accepted.
The applicable prices are those quoted on the website at the time the order is placed. The prices are displayed for each product and are inclusive of VAT (Value Added Tax). Customers are informed of the breakdown of delivery costs when the order is placed. TEMATIKA reserves the right to make any changes it considers necessary at any time and without prior notice; it may update, even on a daily basis, products and prices in accordance with new items that arrive.
Purchases made by legal or natural persons who reside in countries outside of the European Union do not include import taxes (tariffs), which must be paid in cash upon delivery. No orders will be processed for P.O. Boxes. For this purchase/delivery system, and due to their tax treatment, territories of Ceuta, Melilla and Canary Islands are considered to be outside of the European Union.
Payment will be made in the last step of the shopping process and it is a necessary condition for the formation of the contract.
Payment for all purchases may be made by bank transfer or using the PayPal system. In both cases, the choice of payment method is made during the checkout process on the corresponding screen.
Likewise, payment suppliers or providers may adopt anti-fraud measure which may lead to certain types of operations being rejected. TEMATIKA holds no liability for the application of security policies of this nature.
Once the payment is confirmed you will be sent an e-mail with the confirmation order.
The delivery period stated on the website is of an indicative nature only. However, TEMATIKA will make all necessary efforts to meet the estimated delivery date, but accepts no liability for any possible delays.
Delivery shall be made to the address provided by the customer as indicated below:
5.1 Door to door delivery:
Customer pays transport costs according to the price breakdown generated which depends on the item weight, volume and final destiny.
For purchases made by customers in countries outside of the European Union, as well as Canary islands, Ceuta and Melilla, delivery charges do not include import taxes (tariffs), which must be paid in cash upon delivery. TEMATIKA accepts no liability for any possible delay related to goods clearance process nor for a border confiscation decision.
Delivery shall be made to the address provided by the customer, which may be different from their normal place of residence. Deliveries may be made to their place of work or even to a third person they wish to send a gift to.
5.2 Delivery issues:
If the addressee is absent, notice of delivery will be left in the letter box our courier will arrange with the addressee for a later delivery. After two failed attempts, client should personally contact with the courier company to manage the delivery.
6. Nature of the goods
Our products have been crafted by artisans according to traditional techniques.
This handicraft production may cause slight differences with the picture at the website, in its size, color, textures, etc. which are consequence of a non automated production.
The nature of raw materials can also produce imperfections as differences in color or small scars on natural leather.
7. Exchanges and returns
There are two return procedures which are described below:
7.1. Return or exchange:
Clients can return or exchange the good –with the original packaging- if the delivered item is wrong or it is a defective product. In those cases clients must notify by e-mail within a maximum of 5 working days since reception day.
Upon receipt of the package, check for any external or internal damage and, if necessary, notify the haulier at his usual delivery form. Those comments on the delivery note will be necessary for us to bear with the cost of any broken item. In this case it must be notified by email to firstname.lastname@example.org with attached photos showing the parcel and the damaged item, within 12 hours since reception. Otherwise TEMATIKA won’t be able to accept any claim for transport damages.
7.2. Right of withdrawal:
Customers may exercise their right to withdraw from the sale and purchase agreement within 14 days following reception of the goods.
In the case of returned articles collected from the customer's home, the direct cost of returning the good or service will be borne by the customer, according to the LGCU. This cost will be deducted from the total of the refund.
Once the merchandise has been received in our store, and after its condition has been verified, the refund will be processed according to the payment method used by the customer.
For exercising the right of withdrawal, customers must write a letter to Ms. Eva Sánchez Mateos –TEMATIKA- 16 Medellín street, 3ºB. 45600 Talavera de la Reina, Spain or by email at email@example.com. Anyhow you must state WITHDRAWAL FORM in the subject line.
We will pick up your purchase from the address you specified. The product must be unused and in perfect condition, including accessories, documents, commercial ticket and original packaging.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL:
-The right of withdrawal will not be applicable to:
-The supply of goods made to the specifications of the consumer and user or clearly customized.
-The supply of goods which are not suitable for return due to health protection or hygiene reasons, as imitation jewelry and leather articles.
RETURNS IN INTERNATIONAL:
If you wish to cancel an order, you must notify us within a maximum of 24 hours following the order, since the order may have already been shipped and it is not always possible to halt the delivery. If the order has already been shipped, you will have to accept delivery of the order and contact us within a maximum of 14 days following receipt.
The customer shall be liable for border and local taxes as well as any cost involved in returning the items. If the returning cost is higher than the purchase value, the difference will be charged to the customer via the same method used for payment.
8. Product availability
All orders for products are subject to availability. In the event of any supply difficulties or if products are no longer in stock, you will be immediately informed and, if it so wishes, we will refund any amounts that you may have paid, within 14 calendar days via the same method used for payment.

10. Applicable law and competent court
These General purchase terms are under Spanish legislation. For the interpretation and/or performance of the present contract the parties submit themselves to the courts of Madrid.
